Following on from HSE’s January post, employers using Microbiological Safety Cabinets (MBSCs) & other related Laboratory-based LEVs need to be aware that simply adhering to testing standards such as BS EN 12469:2000 will not be enough to meet full legal obligations under COSHH Regulation 9(2). Employers must ensure they are fully compliant with all the specific information and testing requirements outlined in the regulations. Employers should: Familiarise themselves with the detailed requirements of Regulation 9(2) of COSHH. Ensure that their Thorough Examination & Test (TExT) procedures meet all these requirements, beyond just the recommended standards.
HSE Guidance HSG 258 Controlling Airborne Contaminants at Work details the criteria for LEV testing & reporting. Our team has frequently encountered, assessments on fume cupboards where face readings only have been taken. There was no assessment of fans / air movers, ductwork, operator practice, indicators and substances to be controlled etc. If you haven’t already, you need to prepare for increased enforcement and inspections by HSE in the near future.
